After determining how far (if at all) this will send my opponent, BEN will return to the other marks/grounds to the extent that it is necessary to complete the task at hand. It should be noted, however, that although there is some overlap between needs for earlier markings and specifications for later markings, there are some discrepancies between requirements for older and specifications for later markings. Even though all of the preceding marks are for the same fundamental word mark RAW, none of them are exactly the same as the others. Selecting a single earlier time that indicates the superiority of the opponent’s position becomes more difficult in this case. In the case of a comparison of products and services, BEN will regard the preceding marks as a single homogenous whole, while recognising that they are individually distinct registered rights in their own right. For the sake of this particular circumstance, however, BEN will point out the sentences in each earlier mark that give the most convincing reasoning (Manley,2020).
